Terms of Service

Last updated September 25, 2026

Please read these Terms carefully before using Small Forestry. They explain what the Service does, what you can rely on it for, and the limits of our responsibilities.

1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and VMM Systems LLC, a California limited liability company doing business as Small Forestry ("Small Forestry," "we," "us," or "our"), governing your access to and use of the Small Forestry website, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Small Forestry does

Small Forestry helps private landowners understand and pursue the benefits available to their land. The Service provides informational estimates and tools, which include: eligibility estimates for state property-tax programs for forestland and farmland (such as present-use or current-use valuation programs), information about cost-share programs, lease-income estimates, generated documents and application drafts, and an AI advisor. The states the Service currently supports are indicated within the Service.

The Service relies on information you provide and on third-party and public data sources. Outputs are estimates and informational aids, not guarantees of any outcome, savings, eligibility determination, or program approval.

3. Not legal, tax, or professional advice

Small Forestry is not a law firm, accounting firm, tax preparer, or forestry consultancy, and does not provide legal, tax, financial, or professional forestry advice. Using the Service does not create an attorney-client, accountant-client, or other professional-client relationship.

All estimates, eligibility indications, and generated materials are informational and based on the data available to us and the information you provide, which may be incomplete or out of date. Before acting, you should independently verify results and consult qualified professionals, including:

  • your county tax assessor and your state's revenue department for property-tax program matters;
  • a licensed attorney for legal questions, contracts, and any document you intend to sign or file;
  • a licensed accountant or tax advisor for tax consequences;
  • a qualified professional forester for management plans and forestry practices; and
  • the USDA Natural Resources Conservation Service (NRCS) for cost-share program eligibility and applications.
4. Accounts

Some features require an account. You must be at least 18 years old and provide accurate, complete information. Authentication is handled by our identity provider; you are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@smallforestry.com if you suspect unauthorized use.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • submit information you do not have the right to submit, or information about property you do not own or are not authorized to act for;
  • attempt to access accounts, data, or systems that are not yours;
  • scrape, harvest, reverse engineer, or build a competing product from the Service or its data;
  • interfere with or disrupt the integrity or performance of the Service; or
  • misrepresent generated estimates or documents as official determinations or professional advice.
6. Information you provide

You retain ownership of the information you submit (such as addresses, parcel identifiers, acreage, and survey answers). You grant Small Forestry a non-exclusive license to use, process, and store that information to operate and improve the Service and to generate your estimates and documents. You represent that you have the right to provide the information you submit. Our handling of personal information is described in our Privacy Policy.

7. Generated documents

The Service can generate documents such as management plans, tax and program applications, and agreement drafts, prefilled from your information. You are solely responsible for reviewing each document for accuracy and completeness, for completing any remaining fields, and for signing and filing it with the appropriate party.

We do not guarantee that any generated document will be accepted by any government agency or third party. Some documents are drafts intended as a starting point and expressly require review by a qualified professional (for example, an attorney licensed in your state) before you rely on or sign them.

8. AI advisor

The AI advisor generates responses automatically and may produce information that is inaccurate, incomplete, or out of date. It does not provide professional advice and should not be relied upon as such. Verify anything important independently and with a qualified professional before acting on it.

9. Third-party data and services

The Service incorporates data and services from third parties and public records, including county GIS and parcel records, state revenue-department valuation and tax-rate publications, USDA NRCS program information, satellite and aerial imagery providers, AI model providers, and our payment processor. We do not control and do not guarantee the accuracy, completeness, or availability of third-party data or services, and we are not responsible for their content.

10. Fees, subscriptions, and one-time purchases

Paid features are offered either as an auto-renewing subscription (the annual membership) or as one-time purchases (the Tax-savings package, bought for one property or for a group of properties managed as one), billed through our payment processor (Stripe). The price, and whether it renews, are shown to you before purchase.

The membership renews automatically every year until canceled, and your payment method is charged the membership price at each renewal. Between 15 and 45 days before each renewal, we email you a reminder with the renewal date, the price, and how to cancel. If the price or any other term will change at renewal, that reminder says so before the change takes effect. You can cancel at any time from your Account page, and cancellation takes effect at the end of the current membership year.

A Tax-savings package is a one-time purchase and does not renew. It applies to the property, or group of properties, it was bought for and does not expire, though using some paid features may also require an active membership. Unless stated otherwise, fees are non-refundable except as required by law.

11. Intellectual property

The Service, including its software, content, and trademarks, is owned by Small Forestry or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Documents generated for you may be used for your own land-management and filing purposes.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY ESTIMATE OR DOCUMENT WILL BE ACCURATE OR ACCEPTED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMALL FORESTRY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, TAX PENALTIES, LOST SAVINGS, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

14. Indemnification

You agree to indemnify and hold Small Forestry harmless from any claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your information, your documents, or your violation of these Terms or of any law or third-party right.

15. Termination

You may stop using the Service at any time and may request deletion of your account and associated personal information as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

16. Changes

We may update the Service and these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state courts located in Santa Clara County, California, and the federal courts of the Northern District of California, for any dispute not subject to other agreed dispute-resolution terms.
